This is a confidential process and the proceedings are not accessible through the public record. Another benefit is that scheduling a mediation is not dependent upon a court calendar. Consequently, it is much more convenient and more timely for both parties.

Mediation is also not bound by the same laws that govern court proceedings or other legal remedies, meaning agreements are oftentimes more creative than those imposed by a judge.

The mediator is also not a judge and thus does not rule for either side. Their job is to facilitate proceedings and help negotiations move forward in order for an amicable agreement to be reached. Finally, without the court's involvement, mediation is a much less expensive route when trying to resolve disputes.
